Shiyan 19 Measures

On October 21, 2026, Shiyan Municipal Bureau of Housing and Urban Renewal, Shiyan Municipal Bureau of Natural Resources and Urban-Rural Development, and the Shiyan Regulatory Branch of the National Administration of Financial Regulation jointly issued the *Implementation Opinions on Implementing the Notice on Improving the Commercial Housing Sales System*, which consists of six parts and 19 articles, and shall take effect as of the date of issuance. Shiyan has become the first third- and fourth-tier city to release the detailed implementation rules.

After the new policy rolled out on August 28, a total of 9 cities across the country have introduced detailed implementation rules. Compared with other cities that have released relevant rules, Shiyan has put forward a number of new measures in its rules, presenting locally differentiated arrangements in aspects including the handling of continued construction projects, the supporting standard of public facilities, and the disbursement timing of individual housing loans.

Difference 1: Separate arrangement for continued construction projects, projects that have obtained construction planning permits but not pre-sale permits before August 28 can be implemented in accordance with the original individual credit policy

Shiyan further subdivides the projects before August 28 and clarifies corresponding provisions, explicitly dividing the projects obtained before August 28 into four categories: "stock projects, continued construction projects, in-transit projects, and legacy historical projects". Among them, "continued construction projects" refer to commercial housing projects that have partially obtained the Construction Project Planning Permit and have not yet gone through the pre-sale permit procedures. It requires the people's governments of all counties (cities, districts) to ensure the completion and delivery of projects on time, and continue to implement the original policies on pre-sale management, fund supervision, approval and acceptance, and individual credit under the premise of strengthening the supervision of pre-sale funds.

In comparison, cities including Beijing, Shanghai, Guangzhou and Wuhan have all clarified that for projects that have obtained (including partially obtained) the Construction Project Planning Permit, the pre-sale conditions, pre-sale fund supervision and other matters shall be implemented in accordance with the original policy provisions, without preconditions. Shiyan sets up a separate category for "continued construction projects" and adds two thresholds of "government ensuring delivery + strengthening fund supervision", further clarifying additional conditions for stock projects that have obtained construction planning permits but have not gone through pre-sale procedures. It is also the only city that explicitly allows the individual credit policy to be implemented in accordance with the original policy (the original policy (No. 47 of Shiyan Construction 〔2023〕) stipulates that when home buyers purchase commercial housing through mortgage loans, the mortgage bank shall directly disburse the mortgage loan to the supervision account specified in the commercial housing sales contract after confirming that the commercial housing sales contract has completed the filing procedures).

The handling of in-transit projects can better reflect the policy orientation. Shiyan explicitly stipulates that "priority shall be given to adopting existing housing sales; for projects that continue to apply for pre-sale, the main structure of the single building shall be capped", and pre-sale can be applied for in accordance with the original pre-sale policy before the end of 2027 after being submitted to the municipal real estate competent department for filing. Shiyan moves the "priority for existing housing sales" requirement in the central document targeting newly transferred land parcels to in-transit projects, and its tendency to push stock projects to shift to existing housing sales is more obvious among the cities that have released detailed rules so far.

Difference 2: No separate capping requirement for pre-sale of newly transferred land projects, priority given to existing housing sales

Shiyan only emphasizes the requirement that "the main structure of the single building shall be capped" in the category of "continuing to apply for pre-sale" for in-transit projects. For projects with newly acquired land after August 28, it only stipulates that "priority shall be given to adopting existing housing sales, and the whole-chain management requirements such as the filing of existing housing sales, deposit supervision, and simultaneous delivery of housing and property right certificates shall be strictly implemented", without setting separate requirements for pre-sale construction progress, which indicates that newly transferred land projects are more likely to implement existing housing sales.

Other cities that have issued implementation opinions have explicitly stipulated in newly transferred or newly announced projects that "the main structure of the single building that implements pre-sale shall be capped".

Among them, Beijing defines capping as the completion of concrete pouring of the top slab of the building, roof structures and supporting facilities, and additionally requires five parties to issue *Acceptance Record of Main Structure Sub-project*; Ningbo allows the building unit as the minimum sales unit, but all buildings in this pre-sale batch must be capped; Shenzhen and Wuhan explicitly require the completion of concrete pouring of the roof structure, and respectively submit the acceptance record signed and sealed by four units, and on-site verification by the district housing management department.

Difference 3: "Subtraction" for public supporting facilities, cancel the supporting construction of talent apartments, and small land parcels can be exempted from kindergarten supporting construction

Shiyan clarifies that for commercial residential land with transfer contracts signed after August 28, the planning conditions shall be implemented in accordance with the new policy: cancel the supporting construction of talent apartments; if the calculated floor area of planned residential buildings is less than 150,000 square meters, the supporting construction of kindergartens can be exempted. Among the detailed rules of various regions, Shiyan is the only city that has formulated provisions to lower the supporting construction requirements of public facilities. The land supply clauses in other cities focus on the capital and ownership dimensions such as installment payment of land price, transfer with scheme, standard of clean land, and separate household mortgage, without touching the supporting construction obligations. The reduction of public supporting facilities will help improve the value structure of projects and effectively reduce the development costs of real estate enterprises.

In addition, neither Shiyan nor Wuhan has clarified the disbursement timing requirements for individual housing loans of projects that newly obtain pre-sale permits after August 28. It is worth paying close attention to whether this change means that there is a certain space for city-specific adjustment in mortgage loan disbursement in various regions.

On the whole, the orientation of Shiyan's detailed rules is mostly consistent with that of other cities that have released relevant rules, but it also puts forward a number of detailed arrangements with local characteristics. First, the arrangement for transition projects is more refined, which clarifies that for projects that have obtained construction planning permits but not pre-sale permits before August 28, the individual credit policy will also be implemented in accordance with the original policy under the requirements of strengthening fund supervision, which indicates that the mortgage loan disbursement timing will be earlier than the disbursement after the completion and acceptance of projects.

Second, the pre-sale construction progress requirement for newly transferred projects is not specified, and the policy emphasizes "priority for existing housing sales", which may become the choice of more cities with large housing inventory.

Third, the supporting construction of talent apartments is cancelled in land supply, and small land parcels are exempted from kindergarten supporting construction, which is more conducive to reducing the development cost of real estate enterprises. Optimizing the supporting construction requirements may become a reference direction for more cities. As the first third- and fourth-tier city to issue detailed rules, Shiyan provides greater flexibility for policies and also offers reference for more cities with lower economic levels.
